These terms govern your use of theclergycouture.com and any order you place through it. Please read them before ordering. By placing an order you accept these terms.
1. Who you are contracting with
This site is operated by Clergy Couture Group LLC, a limited liability company registered in the State of Wyoming, United States, whose registered office is 30 N Gould St, Suite # 68152, Sheridan, WY 82801, United States. The Clergy Couture is a trading name of that company. In these terms, "we", "us" and "our" mean Clergy Couture Group LLC; "you" means the person placing the order.
Orders are dispatched from Sialkot, Pakistan. The seller of record remains Clergy Couture Group LLC.
2. Eligibility
You must be at least 18 years old and able to form a binding contract to order from this site. If you are ordering on behalf of a parish, diocese, religious community, school or other organisation, you confirm that you are authorised to commit that organisation to the purchase.
3. Orders and how a contract is formed
Listings on this site are an invitation to order, not an offer. When you place an order you are offering to buy. You will receive an automatic acknowledgement by email confirming that we have received it. That acknowledgement is not acceptance.
A contract is formed only when we send you a dispatch confirmation, or, for made-to-measure and bespoke work, when we confirm the specification and dispatch date in writing and you pay.
We may decline an order. Reasons include an item being unavailable, an error in the price or description, a specification we cannot make to the standard we require, a delivery address we cannot ship to, or a payment we cannot verify. If we decline an order after you have paid, we refund you in full.
4. Prices and payment
All prices are shown in United States dollars (USD) and exclude import duty and any tax charged on arrival in your country. Shipping is calculated and shown at checkout before you pay.
Payment is taken in full at the time of order, except for trade and bulk orders where a deposit arrangement has been agreed in writing. Your card or bank statement will show Clergy Couture Group LLC.
We take reasonable care to price and describe items accurately. If we discover a material error in the price or description of something you have ordered, we will contact you before dispatch and give you the choice of continuing at the correct price or cancelling for a full refund. We will not simply charge you the higher amount.
5. Made-to-measure and bespoke work
Made-to-measure and bespoke garments are tailored to the specification and measurements you supply.
- You are responsible for the accuracy of the measurements you give us. Our measuring guide sets out how to take them.
- We confirm the specification, the cloth and the completion date in writing before work begins. That written confirmation, together with these terms, is the contract.
- Once cloth has been cut to your measurements, the order can no longer be cancelled for a full refund. We will tell you honestly where the work stands if you ask.
- Because the garment cannot be resold, it is exempt from change-of-mind returns. Fit is handled by free alteration and, where alteration will not save it, by remaking at our cost. Our refund policy sets this out in full.
- Colour, weave and finish of cloth can vary slightly between dye lots. A photograph on this site is a fair representation, not an exact colour match.
6. Delivery, title and risk
Dispatch and delivery times shown on this site and in your confirmation are estimates given in good faith, based on our own processing times and our carriers' published transit times. They are not guarantees, and customs inspection is outside our control. Where you need a garment for a fixed date, tell us before ordering and we will either commit to that date in writing or tell you it cannot be done.
Risk of loss or damage passes to you on delivery. Title in the goods passes to you when we have received payment in full.
Parcels are shipped delivered-duty-unpaid. Import duty, VAT, GST and customs handling fees are your responsibility as the recipient. We declare goods accurately at the price paid and will not under-declare value or mark an order as a gift.
7. Returns, cancellation and refunds
Our refund policy forms part of these terms and sets out your rights to return, exchange and cancel, and the position on made-to-measure goods. Nothing in these terms limits any statutory right you have under the law of your own country, including the statutory right to cancel a distance purchase available to consumers in the United Kingdom and the European Union.
8. Our workmanship
We warrant that garments will be free from defects in materials and workmanship, will match the specification confirmed in writing, and will be made with reasonable skill and care. If a manufacturing fault appears, write to us and we will repair, replace or refund. We do not set an arbitrary time limit on our own workmanship.
This warranty does not cover fair wear and tear, damage from accident, misuse, incorrect laundering or storage, alterations made by anyone other than us, or the natural ageing of natural fibres and metallic threads.
9. Limitation of liability
Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any liability that cannot lawfully be excluded.
Subject to that, our total liability arising out of or in connection with an order is limited to the amount you paid for that order. We are not liable for indirect or consequential loss, or for loss of profit, revenue, business or opportunity.
We are not liable for delay or failure to perform caused by events beyond our reasonable control, including carrier delay, customs action, industrial action, natural disaster, epidemic, war, civil unrest, or failure of utilities or communications networks.
10. Acceptable use of this site
You may not use this site unlawfully, attempt to gain unauthorised access to it, introduce malicious code, scrape it at a rate that burdens it, or use it to infringe anyone's rights. We may suspend access where we reasonably believe this clause has been breached.
11. Intellectual property
All content on this site, including photographs, garment designs, embroidery designs, text, the brand name and logo, belongs to us or is used with permission, and is protected by copyright and trade mark law. You may not reproduce, distribute or use it commercially without our written consent.
Where you supply us with artwork, a coat of arms, a crest, a monogram or a design to be embroidered, you confirm that you own it or have permission to use it, and you accept responsibility for that. We may decline to reproduce anything we believe infringes a third party's rights or misuses ecclesiastical heraldry or insignia.
12. Accounts
If you create an account, you are responsible for keeping your credentials secure and for activity that takes place under your account. Tell us promptly if you believe it has been used without your authorisation.
13. Privacy
Our privacy policy explains what personal information we collect, how we use it and the rights available to you. Clergy Couture Group LLC is the data controller.
14. Complaints and disputes
If something has gone wrong, write to support@theclergycouture.com with your order number. We aim to acknowledge complaints within one working day and to resolve them within ten. We would always rather settle a dispute directly than formally.
15. Governing law
These terms and any dispute arising from them are governed by the laws of the State of Wyoming, United States, and the courts of that State have jurisdiction.
If you are a consumer, this does not deprive you of the protection of mandatory consumer-protection rules of the country in which you live, nor of the right to bring proceedings there where the law of your country gives you that right.
16. Changes to these terms
We may update these terms from time to time. The version that applies to your order is the version published on this site at the moment you placed it. Changes are not applied retrospectively to orders already accepted.
17. General
If any provision of these terms is found to be unenforceable, the remaining provisions continue in force. A delay in enforcing a term is not a waiver of it. These terms, together with any written order confirmation and the policies referred to above, are the whole agreement between us.
